Law360 Recognizes Morris Nichols’ Delaware Focus and National Impact in 2026 Delaware Powerhouse Series

“Morris Nichols Arsht & Tunnell LLP spent the past year counseling special committees through multibillion-dollar transactions, securing a $22.7 million patent verdict and handling major corporate litigation and Chapter 11 cases, continuing the Wilmington firm’s work across the practices that have defined it for decades,” Law360 reported in recognizing Morris Nichols as a 2026 Delaware Powerhouse.

The recognition marks the sixth consecutive year that Law360 named Morris Nichols a Delaware Powerhouse. The publication highlighted the firm’s national practice focused on corporate counseling, corporate and commercial litigation, intellectual property litigation, and bankruptcy and restructuring, as well as its continued focus on serving clients from its single Wilmington office.

The firm’s long-term, strategic focus on Delaware has been a key to its success. “Morris Nichols is not looking to double its size, merge with another firm or establish offices in other jurisdictions,” explained Melissa DiVincenzo, chair of the firm’s Executive Committee.

Corporate litigator John DiTomo concurred, “Our success is never going to be becoming the biggest firm,” he said. “It’s going to be the firm that provides the most sophisticated advice to clients.” Through a well-established approach building collaboration and trust, “Morris Nichols’ model emphasizes lawyers learning from earlier generations of Delaware practitioners and working closely across practice groups.”

Following changes to Section 144 of the Delaware General Corporate Law, Law360 noted that “one of the firm’s busiest areas has been advising special committees of public and private company boards in transactions involving potential conflicts.” Among the firm’s active corporate counseling matters was its representation of the special committee of Mister Car Wash Inc.’s board in its $3.1 billion take-private transaction. Morris Nichols provided Delaware law advice to the special committee in connection with the transaction, which closed in May.

Law360 also highlighted Morris Nichols’ work in Delaware’s courts, including its role in the Moelis litigation, which culminated in a Delaware Supreme Court reversal.

“Bankruptcy and restructuring remains another major component of the firm’s Delaware practice,” Law360 reported, with Morris Nichols serving as lead debtors’ counsel to solar panel installation company Freedom Forever LLC and co-lead counsel to Spanish Broadcasting System Inc. in their chapter 11 restructurings over the past year. Each engagement involves an array of legal and business skills, from litigation to transactions and written advocacy to courtroom appearances, “… you have to be able to do all of it,” reflected Rob Dehney, head of the firm’s bankruptcy group.

IP litigator Rodger Smith described the firm’s core focus on corporate law, bankruptcy, and intellectual property litigation as the “three legs of the stool” supporting Morris Nichols’ growth. In Delaware District Court, Morris Nichols’ intellectual property litigation group secured a major result in November when a federal jury awarded client SmartSky Networks LLC $22.7 million in patent litigation over air-to-ground technology used to provide in-flight Wi-Fi service. “We’re doing national-level” work, Rodger remarked, “and you don’t have to leave our little happy corner of the world called Delaware.”
