Morris Nichols trusts and estates partner Todd Flubacher sat down with life insurance planning firm Newton One as part of their podcast series, Newton Knowledge. Todd joined Mark Singer and Steve Target from Newton One to discuss Delaware trust law issues, including the emergence of silent trusts and Todd’s recent work with beneficiary well-being.

Their conversation covers the impact of some traditional planning techniques on beneficiary well-being and the phenomenon of silent trusts. They explore where and how to use them, and some of the benefits and drawbacks.

They also discuss how to discuss beneficiary well-being with a client at the planning stages, and how to match the practical objectives of a trust with the client’s “why”.  Beneficiary well-being is part of an emerging dialog among lawyers, life insurance professionals, accountants, and wealth management professionals in the planning community to approach trusts from both financial and personal goals.
