What’s Ahead for Delaware Corporate Law in 2026

Morris Nichols corporate litigator Bill Lafferty shared with Law360 Pulse that one of the key areas he is monitoring is Delaware’s continued preeminence in corporate law.
Delaware’s legal community has been united in its commitment to preserving the state’s leadership in corporate law, Bill said, even as other states have increased efforts to attract companies to incorporate outside of Delaware.
Bill said he believes Delaware’s decades of corporate case law, combined with the expertise of its bench and bar, offer a “real advantage,” which will allow the state to maintain its longstanding preeminence.
