Delaware’s Growing Litigation Venue: The CCLD

Law360 Pulse recently covered the growing popularity of Delaware Superior Court’s Complex Commercial Litigation Division (CCLD) as a venue to litigate complex disputes.

Morris Nichols corporate litigator John DiTomo offered insights, observing, “everybody knows about Chancery, but now everyone is starting to know about the CCLD as well.”

When it was established in 2010, CCLD’s docket totaled 38 cases. Its caseload has grown to roughly 110 cases filed per year since 2019.

“There are aspects of the CCLD’s design that were extremely smart,” John observed, pointing to a certain judge assignment policy as one such example.

“Delaware tries to optimize its legal system for those who are going to take advantage of it,” summarized John, and the CCLD has done a good job of that.
