The article analyzes the flurry of recent advancement and indemnification case and statutory law in Delaware, pointing out, among other things, areas of possible divergences among judges and areas of analytical uncertainty. The article also summarizes the broad range of issues that have been addressed in this new law, including who can receive advancement and indemnification, by whom, and under what circumstances.
